<br /> By 9 March 2009, Canada Cove Limited Partnership shall submit a technical report indicating
<br /> its plans and a:time schedule to achieve full compliance with Waste Discharge Requirements
<br /> Order 135-2006-0039 and CDO. R5-2006-0400. The report shall fully describe why the
<br /> I Reclamation Specifications for turbidity, total coliform organisms, biochemical oxygen
<br /> demand, total suspended solids, and pH have been violated and the specific changes that will
<br /> be made to prevent future violations. In addition, the report shall provide a proposed timeline
<br /> for the improvements.

<br /> Any technical report required herein that involves planning, investigation, evaluation,
<br /> engineering design, or other work requiring interpretation and proper application of
<br /> engineering or geologic sciences shall be prepared by or under the direction of persons
<br /> registered to practice in California pursuant to California Business and Professions Code
<br /> sections 6735, 7835, and 7835.1. As required by these laws, completed technical reports
<br /> must bear the signature(s) and seal(s) of the registered professional(s) in a manner such that
<br /> all work can be clearly attributed to the professional responsible for the work.
<br /> Staff are evaluating enforcement actions, which may include civil liabilities, for the continuing
<br /> failure to comply with the conditions of your Waste Discharge Requirements and Cease and
<br /> Desist Order. Failure to submit the technical reports required by this request may result in
<br /> additional enforcement action, including civil liabilities of up $1,000 per day for late or
<br /> inadequate technical or monitoring reports.
