The <br /> Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated <br /> nonattainment to reduce emissions until standards are met. <br /> The construction phase of this project can generate emissions from the movement of <br /> soil, use of heavy equipment, bulk materials handling, asphalt paving and other related <br /> activities. As a result, this project is subject to District Regulation VII I (Fugitive Dust <br /> Prohibitions). The purpose of Regulation VIII is to reduce the amount of fine particulate <br /> matter (PM-10) entrained into the ambient air from man-made sources. Please be <br /> advised that on August 19, 2004 and September 16, 2004, the District's Governing <br /> Board approved amendments to Regulation VIII, Rules 8011-8061 and 8071-8081; <br /> respectively, that become effective on October 1, 2004. Of particular note are <br /> amendments to Rule 8021 (see section 6.3.1); the Dust Control Plan threshold has <br /> changed from 40.0 acres to 5.0 or more acres for non-residential sites. If a non- <br /> residential site is 1.0 to less than 5.0 acres, an owner/operator must provide <br /> written notification to the District at least 48 hours prior to his/her intent to begin <br /> any earthmoving activities (see section 6.4.2).
