We want the property owner <br /> to be aware that active mining and transport of aggregate materials is a neighboring use. <br /> Teichert has been operating its Linne Road mining and processing activities since the <br /> 1950's and anticipates a continuation of operating and transporting material to the market <br /> (via trucks and rail) into the future. We petition the Planning Commission to include a <br /> permit condition and/or a restrictive covenant to be recorded on the final map showing <br /> that the owner acknowledges our right to mine. Specifically, the language should read as <br /> follows: <br /> "The owner shall acknowledge the continued use and operation of Teichert's <br /> commercial sand and gravel business, including the existing aggregate processing <br /> plant and quarries and the associated noise, dust, odor, lights, and traffic including <br /> truck, rail and heavy equipment. The owner and any future owner of the property <br /> shall be restricted from bringing or participating in any action or proceeding to <br /> recover monetary damages or to challenge, restrict, alter, prohibit, diminish, or <br /> limit these aggregate and quarry activities." <br /> Printed on recycled paper.
