1. That there were no written or oral protests at the hearing on the formation of said maintenance district. 2 . That a maintenance district is hereby formed to be entitled "COUNTRY ESTATES MAINTENANCE DISTRICT" referred to in Resolution R-70-2109 adopted November 24, 1970, and that the expenses of maintaining and operating a storm water drainage system and appurtenances and suciz other improvements as are permitted to be constructed pursuant to Division 7 of the Streets and Highways Code of the State of California, in course of installation in accordance with plans and specifications heretofore approved by the County Department of Public Works of San Joaquin County, are to be assessed wholly upon the 'lands lying within the district benefited by said improvements, which is the district hereby determined that will be benefited by said improvements, pursuant to Division 7 of the Streets and Highways Code. Said expenses of maintenance and operation are to .include the necessary repairs, reNlacements, fuel, power, electrical current, care, supervision, and any and all other items necessary for the proper maintenance and operation of a storm water drainage system and appurtenances and such other improvements as may be constructed to serve the area to be in- cluded in the said maintenance district. 3. The Board of Supervisors shall hereafter maintain and operate said improvements in the manner provided in said County Maintenance District Law (Division 7, Part 3, Chapter 26, Streets and Highways Code) , and shall in each year, prior to the tirae of fixing the County tax rata, estimate the co:,t of maintaining and operating the said improvements during the ensuing year, and decide whether or not the cost of the same shall be borne wholly or partially by the maintenance district, and shall, in addition to all other taxes, fix a special tax 2 -
