SAN JOAQUIN COUNTY <br /> HAZARDOUS MATERIALS INFORMATION GUIDE <br /> The following are guidelines to help building permit applicants and business license applicants <br /> determine whether they need to comply with the hazardous materials reporting requirements of <br /> Chapter 6.95 of the California Health and Safety Code. <br /> Chapter 6.95 requires businesses which handle hazardous materials, at the California <br /> Threshold Planning Quantities, to file a "Hazardous Materials Management Plan <br /> (HMMP)" with the Administering Agency. In San Joaquin County, the Office of Emergency <br /> Services has been appointed to be the Local Administering Agency. Businesses that handle <br /> Acutely Hazardous Materials will also be required to file an Acutely Hazardous <br /> Materials Registration Form and possibly complete a Risk Management and <br /> Prevention Program (RMPP). <br /> GUIDELINES: <br /> 1 . Will the owner or future building applicant handle a hazardous material or a mixture <br /> containing a hazardous material in a quantity equal to or greater than 55 gallons, 500 <br /> pounds, or 200 cubic feet at any one time? <br /> IF"Yes"THEN OWNER OR FUTURE OCCUPANT MUST MEET OR BE MEETING THE <br /> REQUIREMENTS OF CHAPTER 6.95,SECTION 25505 OF THE HEALTH AND SAFETY CODE <br /> PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY. <br /> 2. Will the owner or future building occupant handle an Acutely Hazardous Material listed <br /> in the attached Appendix? <br /> IF"Yes"THEN THE OWNER OR FUTURE OCCUPANT MUST MEET OR BE MEETING THE <br /> REQUIREMENTS OF CHAPTER 6.95, SECTIONS 25533 AND 25534 PRIOR TO THE <br /> ISSUANCE OF A CERTIFICATE OF OCCUPANCY. <br /> 3. Will the proposed building or modified facility be within 1,000 feet of the outer <br /> boundary of a school (grades K - 12) and have Acutely Hazardous Materials? <br /> IF"Yes"TO BOTH CONDITIONS,THEN THE OWNER MUST MFFT THE REQUIREMENTS OF <br /> CHAPTER 6.95, SECTIONS 25533 AND 25534 PRIOR TO ISSUANCE OF A BUILDING <br /> PERMIT. <br /> IF FUTURE OCCUPANT IS UNKNOWN AT THIS TIME <br /> The fact that the building for which the permit is being applied does not have a tenant at this <br /> time, does not relieve the owner or his authorized agent from the responsibility under <br /> California law. The owner or authorized agent must indicate whether future occupants will need <br /> to comply with the reporting requirements for the handling of any hazardous materials. <br /> If at a later date, the applicant determines that a tenant will be handling hazardous materials, <br /> the applicant must inform the Office of Emergency Services at (209)944-2116. <br />
