Phipps <br />Jean Phipps <br />5352 E Marsh St. <br />Stockton, CA 95215 <br />Subject: Illegal Disposal of Solid Waste at 5352 E Marsh St., Stockton CA 95215 (APN 159-240-14). <br />San Joaquin County Environmental Health Department (El-ID) conducted a complaint inspection on <br />February 1, 2022 at the above referenced property. The complaint alleged that the people living in a trailer are <br />throwing garbage on the driveway and allowing dogs to defecate on the driveway. The garbage and feces are <br />causing roaches and rats to neighboring homes. The results of the investigation revealed that solid waste was <br />observed in the form of junk and trash on the east, north and west sides of the property. A trailer filled with solid <br />waste was observed on the driveway, west of the home. The disposal of solid waste on the property is a violation of <br />State Law/Regulation and County Ordinance <br />Public Resources Code (PRC), Section 44002 (a) (1) <br />San Joaquin County Ordinance (SJCO), Title 5, Chapter 4, Section 5-2400; Accumulation of refuse, waste, <br />and filth is prohibited, Chapter 4, Section 5-2401; Disposal on premises, Chapter 6, Section5-2600; <br />Disposal area permit required. <br />According to the PRC, Section 45000, 45005, and 45011, this department has the authority to issue an <br />administrative order requiring the owner of a property to take corrective action as necessary to abate a nuisance, <br />cease any illegal action, and establish a time schedule that the site shall be brought into compliance. <br />Effective immediately cease and desist all unauthorized disposal of solid waste onto the above referenced property. <br />Inform the EHD, prior to removal, where the waste will be taken for proper disposal within 7 days of receipt of this <br />letter and remove the waste by February 17, 2022.
