OBSERVATIONS: Metal shavings were observed in the shop on a brake lathe machine. Per owner,the shavings were moved from their previous shop to this new one but they are not planning on using the brake lathe machine at this new shop. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as scrap metal. CORRECTIVE ACTION: Immediately dispose of the metal shaving , make a hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to make your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including Title 22 CCR sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status. This is a Class II violation. 302 CCR 66262.34(d)(2) Failed to have all communication or alarm systems, spill control, or decontamination equipment. OBSERVATION: The facility is not equipped with the following equipment:spill control equipment REGULATION GUIDANCE: All facilities shall be equipped with the following, unless it can be demonstrated to the Department that none of the hazards posed by waste handled at the facility could require a particular kind of equipment specified below: (a)an internal communications or alarm system capable of providing immediate emergency instruction (voice or signal)to facility personnel; (b)a device, such as a telephone(immediately available at the scene of operations)or a hand-held two-way radio, capable of summoning emergency assistance from local police departments,fire departments, or State or local emergency response teams; (c)portable fire extinguishers,fire control equipment(including special extinguishing equipment, such as that using foam, inert gas, or dry chemicals), spill control equipment, and decontamination equipment; and (d)water at adequate volume and pressure to supply water hose streams, or foam producing equipment, or automatic sprinklers, or water spray systems . CORRECTIVE ACTION: Immediately obtain the following equipment: spill control equipment. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation.
