Weber Avenue, V Floor <br /> Stockton, CA 95202 <br /> Re: Property Access Authorization for the Bill Lane Illegal Landfill <br /> 39-CR-0040, San Joaquin County <br /> Dear Mr. McClellon: <br /> To determine if this site qualifies for remediation under the California Integrated Waste Management <br /> Board's (CIWMB) Solid Waste Cleanup Project, the CIWMB will need permission to access the above <br /> property for assessment. The CIWMB anticipates one to two days of site work, which will include <br /> excavating and environmental sampling to quantify and characterize the illegally disposed waste. <br /> The site assessment and hopefully future removal is pursuant to California Public Resources Code <br /> sections 48020-48028, Solid Waste Disposal and Codisposal Site Cleanup-Program. <br /> Any consultants and contractors that may use the Bill Lane property to stage equipment and <br /> perform site assessment are required by the CIWMB to maintain liability insurance with a combined <br /> single limit coverage of $1,000,000 per occurrence. In addition, negligent acts by the State of <br /> California would give rise to a claim under the California Tort Claims Act. <br /> Two copies of a Property Access Authorization form are enclosed. Please have the appropriate <br /> person sign and date one copy of the form and return it to the CIWMB.
