PUBLIC HEitLTH SERVICES <br />SAN JOAQUIN COUNTY <br />ENVIRONMENTAL HEALTH DIVISION <br />Karen Furst, M.D., M.P.H., Health Officer <br />304 East Weber Avenue, Third Floor - Stockton, CA 95202 <br />209/468-3420 <br />August 13, 2001 <br />Bruce Beard <br />C/O Quality Nut Company <br />Post Office Box 739 <br />Empire, California 95319 <br />SUBJECT: Bill Lane Illegal Disposal Site <br />23201 South Santa Fe Road (APN 249-060-14) <br />Riverbank, California 95320 <br />Dear Mr. Beard: <br />FILE COPY <br />The California Integrated Waste Management Board (CIWMB) requests access to the subject property, <br />which you are on record owning, in order to conduct an investigation of reported illegal disposal <br />activities, pursuant to Public Resources Code (PCR), Section 44100(a). <br />Under PCR, Section 44100(b), this investigation may be conducted with the consent of the owner or with <br />an inspection warrant. The CIWMB would prefer to obtain your permission/authorization to complete the <br />investigation and avoid the litigation associated with obtaining an inspection warrant. <br />Any consultants and contractors that may be used by the CIWMB to assist in the investigation are <br />required to maintain liability insurance with a combined single line coverage of $1,000,000 per <br />occurrence. In addition, negligent acts by the State of California would give rise to a claim under the <br />California Tort Claims Act. We believe these measures provide adequate protection to you from our acts <br />during the investigation. <br />Two copies of a Property Access Authorization form and a stamped return envelope are enclosed. Please <br />sign and date one copy of the form and return it in the enclosed envelope by October 8, 2001.
