Lane Ulane@leeandpierce.com] <br />Sent: Monday, December 22, 2008 10:37 AM <br />To: Natalia Subbotnikova [EH] <br />Subject: Palomino Property, Parcel #14 <br />Natalia: <br />I'm following up on the telephone conversation we had late last week regarding Mr. <br />Palomino's southern parcel, #14. I understand that for Mr. Palomino to conduct <br />earthmoving activities on that parcel, an addendum to the the original work plan must be <br />submitted, since prior reports omitted Parcel #14 from site activities. I've discussed <br />this with Mr. Palomino and we will prepare the required addendum shortly after the holiday <br />season. <br />As you know, Mr. Palomino has accepted some fill dirt at the site. I conducted a site <br />walk last week at the request of Peter Palomino to look at the stockpiled material at <br />Parcel 14. According to Mr. <br />Palomino, the dirt is from several sources including: <br />1)Fill dirt provided by the City of Riverbank from downtown public works projects, 2) Fill <br />dirt provided by local developers from a grading project in a planned subdivision in <br />Riverbank, and 3) Fill dirt provided by a local pool contractor from pool construction <br />excavations. <br />According to Mr. Palomino, the parties providing the fill dirt indicated that there is no <br />known contamination in the soil. I conducted a cursory inspection of the fill dirt, which <br />is currently stockpiled near the northern property boundary. The fill dirt appears to be <br />primarily brown sandy silt to silty sand with some gravel and cobble sized particles. <br />There was no visible concrete, asphalt, or other construction debris within the stockpiled <br />fill dirt. No odors or discolored soil was observed. It appears to be typical of native <br />fill material, although no formal testing has been conducted. <br />Please feel free to call me to discuss this matter further. <br />Sincerely, <br />John P.
