D FT <br /> medial will require a large truck to access the treatment plant on the <br /> Property via a route to be approved by the School District. <br /> 6. Site Restoration: The treatment plant will be removed upon completion of the <br /> Work. All underground piping will remain in place but will be capped <br /> appropriately after completion of the Work as approved by the Regional Board. <br /> RPS-1 will be returned to the School District for operation as an irrigation well <br /> if needed. Other remediation wells will be decommissioned in accordance with <br /> San Joaquin County requirements and groundwater surface will be restored to <br /> match existing conditions. <br /> NOW,THEREFORE,the School District and NUSA agree as follows: <br /> 1. License. The School District hereby grants to NUSA a non-exclusive temporary <br /> license, and not a grant of easement or any other interest in the Property, to enter and access the <br /> Property, including ingress and egress to perform the Activities on the Property. NUSA shall <br /> exercise reasonable efforts to conduct the Activities with minimum disturbance to the School <br /> District and upon completion of the Activities shall return the Property to the School District in <br /> substantially the same condition that existed as when NUSA entered the Property. All Activities <br /> performed by NUSA, or the repair of any damages or the loss of production to the Property as a <br /> result of such Activities, shall be at the NUSA's expense. Where the routine entering of the <br /> Property is required,NUSA will provide notification, which may be oral or by electronic mail,to <br /> the School District and obtain approval prior to implementation of any Activities.As part of routine <br /> communications,NUSA shall provide to the School District fourteen (14)days' prior notification <br /> of the scope and the schedule of the work associated with the Activities for the School District's <br /> review. <br /> 2. Term.This Access Agreement shall continue and shall not be revocable for so long <br /> as NUSA is performing the Activities authorized by the Regional Board (or activities related <br /> thereto). The parties agree that it would be inequitable to revoke or terminate this Access <br /> Agreement before the Work is completed. <br /> 3. Compliance with Laws. NUSA shall conduct the Activities in compliance with all <br /> applicable federal, state, and local laws and regulations. <br /> 4. Notices.
