RCRA Permit - Forw*_ Landfill May 1991 <br /> EPA I.D. CAD 990 794 133 Modification 0 <br /> meaning associated with such terms shall be defined by <br /> a standard dictionary reference or the generally ac- <br /> cepted scientific or industrial meaning of the <br /> term. "Director" means the Director of EPA Region 9, <br /> or his designee or authorized representative. <br /> 5. PERMIT RENEWAL <br /> This permit may be renewed as specified in 40 CFR <br /> 270.30(b) and permit condition I.6(b) . Review of <br /> any application for a permit renewal shall consider im- <br /> provements in the state of control and measurement <br /> technology, as well as changes in applicable <br /> regulations. [40 CFR 270. 30(b) , HSWA sec. 212] <br /> 6. DUTIES AND REQUIREMENTS <br /> (a) Duty to Comply <br /> The Owner/Operator shall comply with all <br /> conditions of this permit, except to the extent <br /> and for the duration such noncompliance is <br /> authorized by an emergency permit. Any permit <br /> noncompliance, other than noncompliance <br /> authorized by an emergency permit, constitutes a <br /> violation of RCRA and is grounds for en- <br /> forcement action, permit termination, <br /> revocation and reissuance, modification, or <br /> denial of a permit renewal application. [40 CFR <br /> 270.30(a) ] <br /> (b) Duty to Reapply <br /> The Owner/Operator shall submit a complete <br /> application for a new permit at least 180 days <br /> before this permit expires. [40 CFR 270. 10(h) , <br /> 270.30(b) ] <br /> (c) Permit Expiration <br /> Pursuant to 40 CFR 270.50, this Permit shall be <br /> effective for a fixed term not to exceed ten <br /> years. This Permit and all conditions herein <br /> shall remain in effect beyond the Permit's expira- <br /> tion date, if the Owner/operator has sub- <br /> mitted a timely, complete application (see 40 <br /> CFR 270. 10, 270. 13 through 270.29) and, <br /> through no fault of the Owner/Operator, the <br /> Director has not issued a new Permit, as set. forth <br /> in 40 CFR 270.51. <br /> 4 <br />
