<br />REPORT OF VIOLATIONS
<br />Dear Mr. Basso:
<br />On October 21, 22 and 24, 1991, the California Department of
<br />Toxic Substances Control (DISC) conducted an inspection of
<br />Forward Inc., (Forward) located in Stockton, California.
<br />As a result.of that inspection, violations of hazardous
<br />waste regulations were identified. Specific violations are
<br />listed below. Failure to correct the violations will result in
<br />citations for continuing/additional violations by the DTSC.
<br />I. Schedule of Violations
<br />1. 'Title 22, Division 4.5, Section 66264.90 and Section
<br />66270.30.
<br />Forward failed to follow the written and approved
<br />Sampling and Analysis Plan (SAP) which is incorporated
<br />as Attachment 1 of the RCRA Post -Closure permit dated
<br />June 3, 1991, and Appendix B of the Hazardous Waste
<br />Facility Post Closure Permit issued January 2, 1990, by
<br />DTSC.
<br />2. Title 22, Division 4.5, Section 66264.310 (b) (3).
<br />Forward failed to maintain the ground water monitoring
<br />system at the facility as described in Attachment 3
<br />(Well Design Protocol) of the RCRA Post Closure Permit
<br />dated June 3, 1991, and Attachment 3 (Well Design
<br />Protocol) of the Hazardous Waste Facility Post Closure
<br />Permit issued January 2, 1990, by DTSC.
<br />3. Title 22, Division 4.5, Section 66265.144 (b) (1) (2),
<br />from October 1986, until 1990 and Section 66264.144 (b)
<br />(1) (2) from 1990 through the present.
<br />Forward did not adjust the postclosure cost estimate
<br />for inflation within 60 days prior to the anniversary
<br />date of the Trust, used to meet financial
<br />responsibility requirements.
