The <br /> expansion of the Austin Road Landfill was reviewed under the California Environmental <br /> Quality Act (CEQA) requirements in 19941. A supplemental EIR was also prepared in 1999 <br /> when jurisdiction of the landfill was transferred from the City of Stockton to the County of <br /> San Joaquin, however the change in jurisdiction did not warrant additional CEQA review with <br /> regard to airport concerns. The comment letters from both the SMA and FAA on the 1994 <br /> EIR are attached, as well as the notification from the City of Stockton to the FAA of proposed <br /> construction or alteration. <br /> Forward, Inc. (Forward) purchased the Austin Road Landfill from the City of Stockton in <br /> 2000 and is currently in the process of complying with the County of San Joaquin Use Permit <br /> 99-17(UP-99-17)requirements. Item I.n(1)of UP-99-17 requires that: <br /> "The project sponsor shall request FAA, CIWMB, and LEA review of the <br /> proposed project and specifically, bird abatement programs. The SMA shall <br /> also be notified.
