a_prior to the initiation of gmund nearing,grubhing,grading or excavation <br /> activities,a scheduled to occur during the nesting season(i.e.,normally <br /> approximately February 1—June 30),a preconstruction survey shall be <br /> performed by a qualified biologist. <br /> b.If an occupied golden eagle nes[is detected,a setback of 500 feet from the <br /> nesting area shall be established and maintained dunng the nesting season(i.e., <br /> normally approximately February 1—Jur.e30)forthe penod encompassing nest <br /> building and continuing until fledglings leave nests.This setback applies <br /> whenever construction or other ground disturbing activities must begin during <br /> the nesting season in the presence of nests that are known to be occupied. <br /> Setbacks shall be marked by brightly colored temporary fencing. <br /> c.The qualified biologist shall sena as a biological monitor during those periods <br /> when construction activities occur near active nest areas to ensure that no <br /> Inadvertent impacts on these nests occur_The qualified biologist will have <br /> stvpwork authority in the event construction activities result in disturbance to <br /> an active nest. <br /> 3.White-tailed Kite.White-tailed Bite has been observed foraging in the project <br /> area and suitable nesting habitat is present in the immediate project vicinity. <br /> Participation in the SJMSCP affords the project proponent Incidental Take <br /> authorization for white-tailed kite in the farm of habitat conversion provided the <br /> following Incidental Take Minimization Measures,as outlined in the SJMSCP,are <br /> followed: <br /> a.Prior tothe initiation of tree removals/prunirng,ground clearne,grubbing, <br /> grading or excavation activities scheduled to occur during the nesting season <br /> (i.e.,normally approximately,February 15—.sepramher 15),a preconstruction <br /> survey shall be performed by a qualified biologist.Ifthere is a break in <br /> construction activities of more than 7 days during the nesting season a new <br /> pfeconstructien survey must be conducted. <br /> b.A setback of 200 feet from nesting areas shall be established and maintained <br /> during the nesting season for the period encompassing,nest building and <br /> continuing until tledglings leave nests. <br /> c.This setback applies whenever consimction or other ground-6stu rbtng <br /> activities must begin during the nesting season in the presence of nests that are <br /> known to be uccupied.Setbacks shall be niarked by brightly colored temporary <br /> fencing, <br /> d.The qualified biologist shall serve as a biological monitor during those periods <br /> when construction activities occur near active nest areas to ensure that no <br /> inadvertent impacts on these nests occur.The qualified biologist will have stop <br /> work authority in the event construction activities result in disturbance to an <br /> active nest. <br /> 4_Burrowing owl.Suitable habitat is present on and near the project sites and in <br /> the projectvlcinliy and the spectres could colonize the site in the future. <br /> Participation in the 5JMSCP affords the project proponent Incidental Take <br /> authorization for burrowing owl pursuant to CEGA;this provides both forthe <br /> taking of the species incidental to otherwise lawful activities as well as the <br /> conversion of Suitshta burrowing ewl habitat to non-suitable habitat.Consistent <br /> with the measures outlined in the SJMSCP and CDFG 2012,the <br /> following impact minimization measures shall be followed: <br /> a.A"Take Avoidance Survey"shall be performed by a qualified biologist(as <br /> dehned in CDFG 2912,Appendix D)no less than 14 days prior to the initiation of <br /> ground disturbance.A final survey shall be conducted 24 hours prior to ground <br /> disturbance.If there is a break in construction activities of more than 7 days <br /> duri.ng the nesting season a new preconstruction survey must be conducted <br />
