Environmental Health Department <br />Underground Storage Tank Program Inspection Report <br />Date: <br />December 19, 2019 <br /> Facility Address: <br /> 3300 Waterloo Rd, Stockton <br /> Facility Name: <br /> Nella Oil #427 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 209 CCR 2716(a-e) Failure to conduct the designated UST operator visual inspection at least once every 30 days. <br />OBSERVATION: The designated operator failed to check and note all required items on the visual inspection <br />reports. The incorrect and missing information included the following from the inspection reports: <br />-The October 2019 report was dated 10/27/19; the alarm printout was dated 10/26/19. <br />-The December 2019 report was dated 12/27/18; the alarm printout was dated 12/31/18. <br />-No owner/operator signature was on the 12/27/18, 1/29/19, and 2/27/19 inspection reports. <br />REGULATION GUIDANCE: During the visual inspection, the designated operator shall check that all required <br />testing and maintenance for the UST system have been completed and shall check all required items on the report. <br />CORRECTIVE ACTION: Ensure that designated operators performing visual inspections at this facility are including <br />all of the required information on the reports. <br />----- <br />OBSERVATION: The designated operator inspections for the following months were performed more than 30 days <br />after the previous inspection: <br />- Initial inspection on 11/27/18, next inspection performed on 12/31/18 (34 days) <br />- Initial inspection on 5/28/19, next inspection performed on 6/28/19 (31 days) <br />- Initial inspection on 7/28/19, next inspection performed on 8/28/19 (31 days) <br />REGULATION GUIDANCE: The designated operator visual inspections shall be conducted within 30 days or less of <br />the previous inspection. <br />CORRECTIVE ACTION: Ensure that all designated operator inspections are performed within the required time <br />frames. <br />----- <br />OBSERVATION: Designated operator reports were not signed within the required time frame. <br />-The 6/28/19 designated operator report was signed by the owner/operator on 7/2/19. <br />-The 5/28/19 designated operator report was signed by the owner/operator on 6/3/19. <br />REGULATORY GUIDANCE: Within 48 hours of the completion of the designated UST operator visual inspection, <br />the designated operator shall sign and provide the owner or operator with a copy of the inspection report. Within 48 <br />hours of being provided a signed copy of the report, the owner or operator shall provide a description of each <br />corrective action taken or to be taken and shall sign and date the report, acknowledging the identified compliance <br />issues. <br />CORRECTIVE ACTION: Ensure all designated operator inspection reports are completed and signed within the <br />required time frame in the future. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />FA0003600 PR0231765 SC001 12/19/2019 <br />EHD 23-01 Rev. 9/20/2019 Underground Storage Tank Program OIRPage 5 of 6 <br />1868 E.
