One roll-off bin, north of the manufacturing building,was labeled"non-hazardous waste", "toxic", "FILTER <br /> CAKE", "absorbent, vegetable oil", "accumulation start date 04/01/22". Patrick Samson stated that this bin contains <br /> filter cake consisting of filter media and biodiesel. The final biodiesel product is filtered through the filter media. <br /> The spent filter cake is transferred to the roll-off bin and disposed of as non-hazardous waste. A generator waste <br /> profile sheet was provided by Patrick Samson. The profile sheet was not dated and does not include analytical <br /> data. The profile does not include Title 22 California Code of Regulations(T22 CCR)section 66261.24(a)(6)acute <br /> aquatic toxicity data. The biodiesel product Safety Data Sheet indicates that biodiesel is aquatic toxic at 2.8-4.6 <br /> ug/L, much lower than the hazardous waste aquatic toxicity limit of 500 mg/L. <br /> 2. Waste water from the on-site laboratory is collected in 50 gallon plastic drums and placed in wastewater tank <br /> T-116. The T-116 contents are shipped off-site as non-hazardous waste to the East Bay Municipal Utility District <br /> (EBMUD) . The lab waste water drum on-site was tested with pH paper and pH 6.5 was found. The water <br /> contained one aqueous phase and contained significant white precipitate, probably from glassware cleaning <br /> detergent. There was no hazardous waste determination documentation on-site for the lab wastewater before it is <br /> transferred to tank T-116. <br /> REGULATION GUIDANCE: <br /> Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 <br /> California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes <br /> that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. <br /> Title 22 CCR section 66261.2—Definition of Waste <br /> Title 22 CCR section 66261.3—Definition of Hazardous Waste <br /> A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 <br /> California Code of Regulations(CCR)section 66262.11 for at least three years from the date that the waste was <br /> last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include Safety Data <br /> Sheets(SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: <br /> 1. Make a hazardous waste determination for the filter cake waste. Include determination information regarding <br /> T22 CCR 66261.24(a)(6)aquatic toxicity since biodiesel product is aquatic toxic. <br /> 2. Make a hazardous waste determination for the lab waste water. Include determination information regarding <br /> T22 CCR 66261.24(a)(6)aquatic toxicity since the water appears to contain significant amounts of detergents. <br /> Make a hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data <br /> Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. <br /> Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Use a <br /> laboratory certified to test samples for hazardous waste according to Title 22 CCR. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
