and the project will be performed under the responsible charge of a qualified Partner representative. <br /> Laboratory results will be compared with San Francisco Bay Regional Water Quality Control Board <br /> (RWQCB) Environmental Screening Levels (ESLs). Partner will secure the necessary drilling permit from the <br /> SJCEHD. Permit acquisition will involve submitting a completed application and site plan to the SJCEHD <br /> for review and approval and remitting the necessary fees. The turnaround time of the SJCEHD to issue the <br /> permit is expected to be no more than two weeks. <br /> Health and Safety Plan <br /> The proposed work may involve hazardous conditions and potential contact with hazardous substances, <br /> and to mitigate risk and meet safety regulations, Partner will develop a Health and Safety Plan (HASP) that <br /> is specific to the Subject property. The HASP will conform to the Occupational Safety and Health <br /> Administration (OSHA) requirements, under Hazardous Waste Operations & Emergency Response 29 CFR <br /> 1910.120. The HASP is designed to reduce the risk and impact of physical or chemical exposure that may <br /> affect workers at the property. The HASP will include information about chemicals expected on the site, <br /> health and safety procedures for working on site, and emergency response procedures. <br /> Utility Clearance <br /> As required by law, Partner will contact the California one call center for underground utilities location at <br /> least two or three working days prior to beginning intrusive subsurface activities. Partner will retain a private <br /> utility locator to evaluate the assessment locations for underground utilities. Partner will review relevant <br /> available site plans provided by the owner or others to further understand locations and other conditions <br /> related to buried utilities. Given the precautions, Partner will not accept liability from damages arising from <br /> any harm to or disruption of utilities caused by the site work. <br /> Geophysical Survey and Private Utility Clearance <br /> Partner will retain the services of a qualified geophysical contactor to perform a geophysical survey. The <br /> geophysical survey will be completed to further evaluate location of private and unmarked utilities as well <br /> as any subsurface structures [i.e. abandoned underground storage tanks (USTs), oil-water separators <br /> (OWSs), septic/leach fields, or other subsurface infrastructure] that may be present on the subject property. <br /> The survey will consist of a combination of geophysical technologies as determined by the contractor based <br /> on surface materials, geology, and potential subsurface anomalies. Anomalies identified will be marked on <br /> the ground for follow-up investigation. <br /> Sampling procedures will generally conform to the requirements of the California State Water Resources <br /> Control Board, California Department of Toxic Substances Control, and the United States Environmental <br /> Protection Agency (EPA). A state-certified laboratory will analyze the samples and the project will be <br /> performed under the responsible charge of a qualified Partner representative. Laboratory results will be <br /> compared to the California Environmental Screening Levels. <br /> Soil Borings <br /> Partner will direct drilling of four soil borings on the property using direct-push equipment. Each boring will <br /> be advanced for investigation of the identified environmental concerns mentioned above. Partner's <br /> proposed boring locations will be determined in the field based upon utility conflicts, findings of the <br /> geophysical survey, and Partner's professional judgment. <br />
