Diesel spill <br />was a result of a diesel tank falling off of the semi truck. <br />OBSERVATIONS: <br />On Tuesday, March 1, 2022 San Joaquin County Environmental Health (EHD) received a spill report and complaint <br />regarding a 5-gallon diesel spill along southbound Interstate-5, just before Highway-12 exit. Called and spoke with Officer <br />Rick Schmier to gather information on the spill. Per Officer Schmier, there were no waterways affected or injuries. The <br />saddle tank fell off of a semi-truck causing the diesel spill. Called and spoke with Juan Armendarez, HazMat Manger with <br />Caltrans who stated the estimated amount of the diesel spill is 10-gallons. Arrived at the spill location and met with Juan. <br />The tank was not secured on the semi-truck and the diesel tank fell off causing a diesel spill on the right-hand shoulder <br />behind the "FOOD NEXT EXIT" sign right before Highway-12. Received the clean-up company name (All Environmental <br />Services) from Juan. Clean up has not yet been completed. When EHD left spill site, Caltrans was waiting for the clean-up <br />company to arrive to cover the spill area. Photos were received from Juan with the spill covered and has been marked for <br />USA Dig. <br />Please be advised that the disposal of any waste [HSC 54111 or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. [HSC <br />25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Facilitate spill cleanup by properly trained individuals, provide hazardous waste determinations and waste/hazardous waste <br />disposal records for impacted material to the EHD. <br />Notice to abate was emailed to Andy with JT Cargo Inc. on March 1, 2022. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />f: Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />kORRECTIVE ACTIONS / ORDER: <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
