S A N J 0 A Q I I I Irl Environmental Health Department CCUNT Underground Storage Tank Program Inspection Report Facility Name: Facility Address: Date: BILLJAR VALERO 153 E ELEVENTH ST,TRACY January 19, 2023 SUMMARY OF VIOLATIONS (CLASS I,CLASS II,or MINOR-Notice to Comply) Item# Remarks 208 CCR 2716(a-e) Failure to comply with the designated operator inspection requirements. 1)OBSERVATION: The designated operator inspections for the following months were performed more than 30 days after the previous inspection: - Initial inspection on 7/24/2022, next inspection performed on 8/24/2022(31 days) - Initial inspection on 8/24/2022, next inspection performed on 9/25/2022(32 days) - Initial inspection on 10/25/2022, next inspection performed on 11/25/2022 (31 days) - Initial inspection on 11/25/2022, next inspection performed on 12/26/2022 (31 days) REGULATION GUIDANCE: The designated operator visual inspections shall be conducted within 30 days or less of the previous inspection. CORRECTIVE ACTION: Ensure that all designated operator inspections are performed within the required time frames. --------------------------------------------------------------- 2)OBSERVATION: The designated operator failed to check and note the correct test dates for the overfill prevention test on the designated operator inspection reports. The overfill prevention test was conducted on 11/9/2022. REGULATION GUIDANCE: During the inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and document the dates they were done. CORRECTIVE ACTION: Ensure that designated operators performing inspections at this facility are including all of the required information on the reports. This is a repeat violation, Class Il. 209 CCR 2715(c)(3),2715(c)(4) Failure to maintain a copy of the"Facility Employee Training Certificate"on-site. OBSERVATION: The Facility Employee Training Certificate dated 1/26/2022 with dates 5/25/2022 and 6/24/2022 listed underneath does not list employee initial dates or employee dates assuming responsibility. New training certifications were not created for the trainings conducted on 5/25/2022 and 6/24/2022. REGULATION GUIDANCE:All site employees must be trained prior to taking responsibility as a facility employee if after October 1, 2018, or within 30 days of hire if prior to October 1, 2018. The Facility Employee Training Certificate shall contain accurate information for all employees trained. CORRECTIVE ACTION: Update the Facility Employee Training Certificate to contain the accurate information and submit a copy of the updated form to the EHD. This is a repeat violation, Class II.
