OBSERVATION: The Facility Employee Training Certificate dated 12/23/2022 list incorrect initial training dates and the"Assuming Responsibility as an Employee"are not listed. REGULATION GUIDANCE:All site employees must be trained prior to taking responsibility as a facility employee if after October 1, 2018, or within 30 days of hire if prior to October 1, 2018. The Facility Employee Training Certificate shall contain accurate information for all employees trained. CORRECTIVE ACTION: Update the Facility Employee Training Certificate to contain the accurate information and submit a copy of the updated form to the EHD. This is a repeat violation, Class ll. 210 CCR 2715(c)Failure to provide initial training,train every 12 months, and have a trained employee present. OBSERVATION: The designated operator employee training for Shannon Vanluchem was not performed. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of the training records to the EHD. This is a Class II violation. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION: The 87, 87 aux, and diesel spill containers were replaced on 11/5/2021 and a permit was not obtained from the EHD. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the[UST COMPONENT REPAIR OR REPLACEMENT] . A"Failure to Obtain a Permit" penalty applies. This is a repeat violation, Class ll.
