3 of 14 <br /> Program Overview <br /> Employers are required to have a written Hazard Communication Program (HCP) if their <br /> employees may be exposed to hazardous chemicals. Components of the HCP include training, <br /> chemical labeling and inventories, safety data sheets, hazard assessments and exposure <br /> controls. <br /> The Hazard Communication regulation, Title 8 Section 5194, addresses the hazardous <br /> chemicals in the workplace. <br /> Proposition 65 is the Safe Drinking Water and Toxic Enforcement Act was added to the <br /> hazcom regulation in 1991(Section 5194(b)(6). The Prop 65 requires the governor to <br /> publish a list of chemicals known in the State of California to cause cancer, birth <br /> defects, or reproductive harm. It also requires that businesses provide a clear and <br /> reasonable warning before knowingly and intentionally exposing anyone to a listed <br /> chemical. <br /> The HazCom regulation is aligned with federal OSHA regulation and incorporates <br /> components of the United Nations' Globally Harmonized System (GHS) of Classification <br /> and Labeling of Chemicals. Information on GHS is available on the federal OSHA <br /> website www.osha.gov <br /> California's worker safety regulations specify safe work practices for employees who <br /> handle pesticides. <br /> Provide training for fumigant safe handler to each handler involved in the application <br /> or confirm that each pesticide handler participating in the application has received <br /> fumigant safe handling information in a manner they can understand within 12 <br /> months.
