SAN JOAQUIN <br />---COUNTY- <br />EnvironmentalHealth Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: C & S WHOLESALE GROCERS (STOCKTON LOGISTICS) Date: Nov 17, 2022 <br />RP Mailing Address: 10 OPTICAL AVE Record ID#: COTJOP7DX <br />KEENE, NH 03431- Program Element: 2546 <br />Spill Location: 4199 GIBRALTAR CT, STOCKTON Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />10-gallons of diesel released on to asphalt and dirt as a result of a broken hose on a reaper unit on a trailer. Absorbents <br />were placed on the release and a clean up contract has been contracted to conduct clean up. <br />OBSERVATIONS: <br />On 11/12/2022, San Joaquin County Environmental Health Department (EHD) received a spill report for 10-gallons of diesel <br />release. Called reporting party, Mike Masters, Corporate Compliance Manager with C&G Wholesale Grocers. Per Mike, the <br />release occurred the 11/11/2022 but their contractor who had the release did not inform them of the release. Their staff <br />placed absorbents on the release and informed Mike and a clean-up contractor was dispatched to conduct clean-up, Clean <br />Earth. Received notification that clean-up was completed 11/12/2022 in the evening, generating 3 drums of solid and 3 <br />drums of liquid waste, and photos will be coming soon. Photos were received 11/14/2022, per Mike he is actually sending <br />out contractor again to do further remediation on the asphalt due to staining observed on the asphalt and staining in the dirt. <br />The clean-up company could not dig further without a dig permit. Per Mike a dig permit has been applied for and excavation <br />will be conducted after approval. He will let EHD know when additional clean-up is scheduled. <br />Arrived on site today, 11/17/2022, to verify clean-up on asphalt. Met with Michael Serrano, US Ecology Field Service Project <br />Foreman, and Tony Ram, C&S Wholesale Grocers Facilities Maintenance Supervisor. The impacted dirt was secured with <br />cones. Per Michael, they cleaned the impacted asphalt with Simple Green degreaser, then with absorbent and finally <br />powerwashed and drum vaccumed. The area was still wet from powerwashing upon arrival. Observed some sheen on the <br />asphalt. Discussed the sheen with Michael and he said the asphalt has already lost the coating due to the diesel stain and <br />since asphalt has oil in it already, there will always been a sheen that comes up when water is introduced. Some of the <br />asphalt was already eroding due to the breakdown from the diesel release. Per Michael, more absorbent and power washing <br />will not remove the sheen and he touched the ground to show it was no longer slick. Per Michael the sheen is not related to <br />the diesel. US Ecology does not have concerns of diesel remaining on the asphalt needing additional remediation. 1 drum of <br />solid waste and 3 drums of liquid waste were generated today. The drums will remain on site and will be hauled as <br />hazardous waste at their next pick up. The final remediation needed is on the impacted dirt. Excavation will be conducted <br />11/21/2022. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. [HSC <br />25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Facilitate spill cleanup by properly trained individuals, provide hazardous waste determinations and waste/hazardous waste <br />disposal records for impacted material to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
