We contacted AES who confirmed that the insured contacted AES
and requested their response. We requested and obtained supporting documentation for their invoice from
AES. According to AES, they responded on the day following the incident to find that an unspecified volume of
both diesel fuel and engine fluids had impacted the soil, due to the fire-fighting efforts by the responding Fire
Department, and spread across an area measuring approximately fifty (50) feet wide, by eighty (80) feet
long. AES pumped the remaining virgin diesel fuel from both burned saddle tanks into two (2) 55-gallon drums,
in order to prevent additional spilling of diesel fuel during the future towing and recovery of the remains of the
insured vehicle from the scene. The drums were transported back to the AES shop for staging and profiling,
prior to disposal. The petroleum-impacted soil was then sampled for analysis and preparation for disposal, prior
to a return for excavation.
On October 6, 2022, AES returned to the scene with heavy equipment and excavated nearly twenty-eight (28)
tons of petroleum-contaminated soil, which was loaded into two (2) roll-off containers. Surrounding, native soil
was backfilled into the excavated area, then compacted and regraded to pre-spill contours. The excavated
material was transported back to the AES shop for staging and profiling, prior to disposal.
Regarding the disposal documentation: since we did not request the contractor (All Environmental Services) and were
unfamiliar with their abilities/documentation standards, we had to deal with what we were given by them, which are
the copies in your possession. Yes, typically our contractors know ahead of time to get us either the landfill scale tickets
or manifest copies signed/dated by the disposal facility.
If you need additional docs, their information is listed below and you can reference either their Invoice # 1310 or Turh
Trucking, Inc.:
allenvironmentalserviceslIc@gmail.com
209-648-8060
Hugh Galyean, CHMM
Environmental Specialist
Custard Insurance Adjusters, Inc.
4875 Avalon Ridge Parkway
Peachtree Corners, GA 30071
Office: (678) 287-5443
Fax: (770) 209-8854
Cell: (706) 307-0807
www.custard.com
From: Presto, Carol [EHD] <cpresto@sjgov.org>
Sent: Thursday, February 23, 2023 4:44 PM
To: Galyean, Hugh <hgalyean@custard.com >
Subject: [External] RE: OES# 22-5826; cia file 091-12702
1
