Your complaint will be referred to the appropriate agency for <br />investigation. Your complaint tracking number is COMP-54083. <br />A summary of the information you provided is provided below. If you need to correct any <br />information or have questions about your complaint, please send your request or questions <br />to complaints(&,calepa.ca.gov. <br />Thank you for taking the time to notify us of your concern. <br />Description: I am reporting possible hazardous waste transporter violations by Patriot <br />Environmental. <br />Union Pacific Railroad (UP) reported an ink spill using Cal OES spill report 22-2212 on 4- <br />18-22. A staff person from the San Joaquin County Environmental Health Department <br />(SJCEHD) responded to the site and watched the cleanup done by Patriot Environmental. <br />The spill waste was placed in two 55-gallon drums and labeled as "hazardous waste". On <br />the same day, Patriot transferred the drums using only a bill of lading from 1000 E Roth <br />Rd, French Camp, CA to 1449 S Union St, Stockton, CA (same location as 833 E Eighth <br />St, Stockton CA). Both sites have UP staff on-site. At 1449 S Union St, Patriot removed <br />the drums from their vehicle and placed them in a storage area. Three days later, on 4-21- <br />22, Patriot returned to 1449 S Union St and used a hazardous waste manifest to haul the <br />drums to a TSDF in Long Beach. <br />My concern is that Patriot transferred RCRA D001 hazardous waste on 4-18-22 without a <br />hazardous waste manifest to an unauthorized location and unloaded the drums onto the <br />1449 S Union St property where they were stored for three days. Since the drums were <br />unloaded I don't think the T22 CCR 66263.18 Exempt Transfer Facility rule is applicable. <br />The hazardous waste manifest eventually used (022452620JJK) appears to have an <br />inaccurate generator date of 4-21-22 since the waste was generated on 4-18-22. <br />SJCEHD is addressing the UP hazardous waste generator violations. This complaint is to <br />refer any transporter issues to DTSC. <br />2
