SAN JOAQUIN -COUNT, <br />Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: PRIVATE OWNER <br /> Date: May 21, 2020 <br />RP Mailing Address: 2145 RED RIVER COURT Record ID#: CO8HDFWNF <br />STOCKTON, CA 95206- Program Element: 2546 <br />Spill Location: 705 W WEBER AVE, STOCKTON Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />APPROXIMATELY 2 GALLONS OF OIL RELEASED ON TO WATER DUE TO SUBMERGED BOAT. <br /> <br />OBSERVATIONS: <br />Chris Magro, marina manager used absorbent pads and booms to contain gasoline release. Diver contacted to get boat out <br />of the water. Site not confirmed clean. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5(a).1. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste <br />manifesting procedures [HSC 25160 (b)(3)]. Provide a copy of the hazardous waste disposal records to the EHD for all <br />clean up debris associated with this spill clean up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />6 Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Please manage all waste generated from clean-up, including used absorbent pads according to Title 22 California <br />Code of Regulations for hazardous waste, if profiling suggest the waste to be hazardous waste.
