Unknown amount of mineral oil. Not cleaned. Covered. <br />OBSERVATIONS: <br />Approximately 10 gallons of mineral oil was released from one pole with two mounted transformers due to equipment <br />malfunction. Spill occurred on soil. Per Alex Steele, clean up could not be completed due to muddy ground making vehicle <br />access inaccessible. Plastic is placed over spill due to expected rain event on 11/8/2021. <br />Clean-up is pending. PCB analytical results are pending. No storm drains or water ways impacted. <br />Immediately clean the mineral oil on soil. Please be aware that all impacted soil has to be excavated and disposed of under <br />the appropriate waste manifesting procedure [HSC 25160 (b)(3)]. The disposal of any hazardous waste, or the causing <br />thereof, is prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br />[HSC 25189.5 (a).]Please ensure that all necessary spill notifications to other agencies are made. Notify EHD (48-hours) in <br />advance of any cleanup activities. Provide PCB analytical results and disposal records for all generated wastes. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />5 Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />" Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />" Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Within 30 days. <br />Other Correction <br />Submit PCB analytical results immediately. <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
