SAN_JOAQUIN <br /> Environmental Health Department <br />--COUNTY <br />Gret)f neSS <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: MARK PATCH EN Date: Aug 02, 2021 <br />RP Mailing Address: Record ID#: COWEOCWDC <br />Program Element: 2546 <br />Spill Location: 705 W WEBER AVE, STOCKTON <br /> <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />RECEIVED NOTIFICATION FOR A POTENTIAL RELEASE RESULTING FROM A BOAT ACCIDENT (PLEASURE CRAFT <br />VESSEL CF #9908VF). DURING BOAT REMOVAL PROCESS, SHEEN WAS OBSERVED ON THE SURFACE OF <br />WATER. <br />OBSERVATIONS: <br />On 7/31/2021, received notification from Chris Magro, Director of Marina Operations for a potential release from a sunken <br />boat (CF#9908VF). There was no evidence of sheen and no fuel odor was detected at the time. Dock hands deployed hard <br />and soft boom as a safety measure. On 8/2/2021, sheen was detected on the water during the boat removal process. <br />Absorbent pads were applied to absorb the sheen. <br />Clean up all released material and dispose of it under all appropriate waste manifesting and waste disposal laws and <br />regulations. The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility <br />which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous <br />waste shall be disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Make a <br />hazardous waste determination for all waste materials and dispose of them as required, and provide proof of correction and <br />copies of waste disposal records to the END. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
