SAN JOAQUIN <br /> Environmental Health Department <br />COUNTY <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: PHILLIP DEVAUGHN <br /> Date: Apr 26, 2021 <br />RP Mailing Address: 71 10 ST <br /> Record ID#: C00053723 <br />OAKLAND, CA 94607- Program Element: 2546 <br />Spill Location: 705 W WEBER AVE, STOCKTON <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />APPROXIMATELY TWO GALLONS OF DIESEL FUEL RELEASED FROM A SUNKEN SAILBOAT INTO THE WATER AT <br />STOCKTON MARINA. CAL OES CONTROL #:21-2213 <br />OBSERVATIONS: <br />April 26, 2021: Received notification that a 33-foot sailboat became submersed under water in Slip C7 at Stockton Marina <br />and released approximately two gallons of diesel. Marina personnel deployed hard boom and absorbent pads. Observed oily <br />build-up on water's surface in slips C6, C7, C8, and C9. Observed sheen on the water's surface in slips C3, C11, C4. <br />Clean up all released material and dispose of it under all appropriate waste manifesting and waste disposal laws and <br />regulations. The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility <br />which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous <br />waste shall be disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Make a <br />hazardous waste determination for all waste materials and dispose of them as required, and provide proof of correction and <br />copies of waste disposal records to the EHD. <br />VIOLATIONS: <br />Ei Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />" Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the END. <br />Make a hazardous waste determination and provide copies of waste disposal records for all waste generated from <br />cleanup to the EHD. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
