In determining whether a violation is chronic or recalcitrant , the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 chapter 6 . 7 or of any regulation adopted pursuant to Ch . 6 . 7 , not including the corrective action requirements in section 25296 . 10 of the Health and Safety Code (HSC) and Article 11 of chapter 16 of Title 23 of the regulations . On 5/8/2023 , the San Joaquin County Environmental Health Department ( EHD ) performed a routine underground storage tank inspection at the above- referenced site . The site was found to be out of compliance . The violations include but are not limited to the following : - Navdeep Grewal has been the new owner at the above facility since 12/23/2022 . A permit to operate the UST system has not been issued . No person may own or operate a UST unless a permit for its operation has been issued by the local agency to the owner or operator of the UST system .
