Date: May 27, 2020 <br /> <br />RP Mailing Address: 1400 E WATERLOO RD <br />Record ID#: COX940SIL <br /> <br />STOCKTON, CA 95205- <br />Program Element: 2546 <br />Spill Location: 1400 WATERLOO RD, STOCKTON <br />Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately 30,000 gallons of tomato water generated from putting out a fire and was released into the delta. <br />OBSERVATIONS: <br />Arrived on site and met with Brandon Doolan, Stockton Fire Department Incident Commander, Ivo Sahagun, Plant Manager, <br />and Chris Devore, Municipal Utilities Supervisor. The fire department was still in the process of putting out the fire. Water <br />runoff from the fire was observed on the property spilling into the surrounding area. The water had a reddish hue due to the <br />tomatoes. An unknown amount of fire suppressant foam was used to put out the fire. According to Brandon, a bulk of the <br />foam brought to the site was not used. In addition, he did not observe any hazardous chemicals or waste in the fire. Ivo said <br />that the chemicals the facility used were stored in another area of the property. Chris explained that the storm drains at the <br />facility led to McLeod Lake. Runoff from the fire made its way into those storm drains. <br />Per California Code of Regulations (CCR) 66262.11, any person who generates a waste shall determine if the waste is a <br />hazardous waste. Immediately make a hazardous waste determination for each waste and manage them according to Title <br />22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous <br />waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Once the waste has been disposed of, submit the final disposal records to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />"1 Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit final disposal records and any hazardous waste determination documents to the EHD. <br />Other Correction <br />EHD 25-01 Rev. 08/17/17 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE Page 1 of 2 <br />1868 E.
