OBSERVATION: The designated operator employee training for all employees was expired. The most recent training record was for training conducted in March 2022 for one employee. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of the training records to the EHD. This is a repeat violation, Class II. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION: Notification was made to the EHD for the following repair work and the site failed to comply with the permitting requirements: -Notification was received from Elite IV on 8/9/22 for replacement of the 87 relay on 8/9/22. -Notification was received from Elite IV on 11/22/22 for a cold start of the monitoring panel on 11/21/22. No work orders, test results,or other documentation was found on site for these repairs. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. For EHD Notification &On-site Paperwork only permitting, the following is required: a) Provide 48-hour written notification to ust@sjgov.org for repair and testing. b)The component must be tested after repair/installation to verify functionality. c)The service company must provide the following documentation to the tank owner/operator for on-site review by an inspector during the annual UST inspection: 1) Description of part(s)installed (parts list, cut sheets, etc.) 2) Proof of current ICC and manufacturer certifications for individual performing the work 3)Testing documentation to verify functionality of the component after repair If a required permit is not obtained or all conditions are not met, a"Failure to Obtain a Permit"penalty(an additional 100%of the full retrofit/repair permit fee)will apply. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the replacement of the 87 relay and the cold start of the monitoring panel. A"Failure to Obtain a Permit" penalty applies.
