Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />March 24, 2023 <br /> Facility Address: <br /> 15250 N THORNTON RD, Lodi <br /> Facility Name: <br /> Love's Travel Stop #538 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was lacking or insufficient. The training program was not followed when a spill <br />occurred on the 3/18/2023. The training program should be reviewed with the employees. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Email Nick Loehrer Nloehrer@sjgov.org employee training records for the training <br />program. Immediately prepare or update the facility's training program, log into the California Environmental <br />Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the <br />EHD for approval. <br />This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: There were only two employees that were trained on Hazardous Material Business Plan. All <br />employees must receive annual training on the HMBP program. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is a Class II violation. <br />FA0021886 PR0539990 SC001 03/24/2023 <br />EHD 19-01 Rev. 12/06/2021 Hazardous Materials Program OIRPage 3 of 4 <br />1868 E.
