The following is an itemized list of hazardous materials violations that have not been addressed for H.I. BERRY NURSERY LLC as of July 27, 2023. Open violations from June 16, 2023 inspection Violation#9-Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. -The business plan was not submitted for Calendar years 2021. -The business plan for calendar years 2022 was submitted incomplete passed the January 15th due date; the business plan was submitted on 12/1/2022 did not include the plans section. -The business plan for 2023 did not include the plans section. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#11 -Failed to provide or document initial and/or refresher training to appropriate personnel. OBSERVATION: Employee Training Records for the last three years were not available on-site at the time of the inspection. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to,familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice,for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years.
