SAN JOAQUIN <br /> Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: JUST IN TIME EVERYTIME <br />Date: Feb 02, 2022 <br /> <br />RP Mailing Address: 1075 MONTAGUE EXPRESSWAY <br />Record ID#: COAPSN5X1 <br />MILPITAS, CA 95035- <br />Program Element: 2546 <br /> <br />Spill Location: 1-5 SOUTH BOUND , STOCKTON <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />VEHICLE ACCIDENT INVOLVING A BIG RIG THAT WENT OFF THE ROADWAY AT SB 1-5 NORTH OF HAMMER LANE, <br />STRUCK TREES RESULTING IN THE RELEASE OF THE SUBSTANCE LISTED FROM THE SADDLE TANK INTO THE <br />DIRT SHOULDER ONLY. NO WATERWAYS IMPACTED. ALL ENVIRONMENTAL SERVICES ASSISTING VVITH <br />CLEANUP. <br />OBSERVATIONS: <br />AT APPROXIMATELY 8:30AM ON 2/2/2022 SEMI TRUCK STRUCK A TREE GOING SOUTHBOUND ON 1-5, APPROX. A <br />MILE NORTH OF THE HAMMER LANE EXIT. APPROX. 40 GALLONS OF DIESEL WAS RELEASE TO THE SOIL ON <br />THE SHOULDER. 80-85 GALLONS WAS PUMPED OUT OF THE SEMI TRUCKS SADDLE TANKS. WHEN VEHICLE <br />WAS DISTURBED BY THE TOW TRUCKS, IT RELEASED APPROX. ANOTHER 2-3 GALLONS OF DIESEL. DIESEL <br />CONTAMINATED SOIL WAS COVERED WITH A TARP BY CALTRANS. SPILL IS PENDING CLEAN UP. SEND <br />NOTIFICATION TO THE SAN JOAQUIN COUNTY ENVIRONMENT HEALTH DEPARTMENT WHEN SPILL CLEAN UP IS <br />SCHEDULED. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />IMMEDIATELY <br />Other Correction <br />EHD 25-01 Rev 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE Page 1 of 2 <br />1868 E.
