SAN,JOAQUIN Environmental Health Department COUNTY INFORMATION REGARDING COMPLIANCE REQUIREMENTS, ENFORCMENT COSTS, ADMINISTRATIVE FINES/PENALTIES, AND REQUEST FOR A HEARING ASSISTANCE — For assistance with this notice, please contact the Registered Environmental Health Specialist who issued the notice at the phone number indicated next to the signature or call the main phone number at (209) 468-3420. AUTHORITY - Personal Cannabis is governed by San Joaquin County Ordinance Code Title 4, Division 10, Chapter 3 and California Health and Safety Code, Sections 11362.1 and 11362.2. COMPLIANCE - The violations identified on the reverse side of this form must be corrected by the indicated compliance date. Failure to correct the violation within the time constraints identified in this notice may result in substantial administrative fines/penalties and/or other legal action. VIOLATIONS - Each violation of the Personal Cannabis Ordinance and each day each violation continues shall constitute a separate violation and be subject to the maximum penalty and any other enforcement remedies available to the County under Title 1, Division 2 and any applicable state or federal statute or pursuant to any other lawful power the County may possess. ENFORCEMENT - Enforcement of the Personal Cannabis ordinance will be done pursuant to Title 1, Division 2 of the San Joaquin County Ordinance Code, unless otherwise specified in the Personal Cannabis ordinance. ADMINISTRATIVE CIVIL FINE/ PENALTY FOR VIOLATIONS - Each violation of the Personal Cannabis ordinance is a separate and distinct unlawful violation subject to the following administrative civil fine/ penalty: Each violation, except for the violation of specified in subsection (b), is subject to an administrative civil fine/ penalty of five hundred dollars ($500.00) per day from the date of the notice of violation and order to abate and continuing for each day thereafter until the violation is abated by whatever means. Each cannabis plant in excess of the legal six plant limit is subject to an administrative civil fine/ penalty of up to one-thousand do!lars ($1,000.00) per day from the date of the notice of violation and order to abate and continuing for each day thereafter until the violation is abated by whatever means. The administrative fine/ penalty amounts shall be cumulative where multiple violations are cited and where multiple administrative citations are issued. ENFORCEMENT COST - The County shall be reimbursed for all time, services, and materials needed to abate a violation of the Personal Cannabis ordinance. PERMIT - If a corrective action required to comply with this notice involves the permitting, improvement, and/or repair to a structure, then, prior to commencing work, you must secure the required permits from the San Joaquin County Building Division located at 1810 East HazeIton, Stockton, CA. REQUEST FOR HEARING - Any person issued an administrative citation may contest the citation by completing a request for hearing form and returning it to the San Joaquin County Environmental Health Department (EHD) within 14 days from the date of the administrative citation by delivery or mail to the EHD at 1868 East HazeIton Avenue, Stockton, CA 95205.
