SAN,JOAQUIN <br /> <br />Environmental Health Department <br />COUNTY <br />INFORMATION REGARDING COMPLIANCE REQUIREMENTS, ENFORCMENT COSTS, <br />ADMINISTRATIVE FINES/PENALTIES, AND REQUEST FOR A HEARING <br />ASSISTANCE — For assistance with this notice, please contact the Registered Environmental Health Specialist <br />who issued the notice at the phone number indicated next to the signature or call the main phone number at <br />(209) 468-3420. <br />AUTHORITY - Personal Cannabis is governed by San Joaquin County Ordinance Code Title 4, Division 10, <br />Chapter 3 and California Health and Safety Code, Sections 11362.1 and 11362.2. <br />COMPLIANCE - The violations identified on the reverse side of this form must be corrected by the indicated <br />compliance date. <br />Failure to correct the violation within the time constraints identified in this notice may result in <br />substantial administrative fines/penalties and/or other legal action. <br />VIOLATIONS - Each violation of the Personal Cannabis Ordinance and each day each violation continues shall <br />constitute a separate violation and be subject to the maximum penalty and any other enforcement remedies <br />available to the County under Title 1, Division 2 and any applicable state or federal statute or pursuant to any <br />other lawful power the County may possess. <br />ENFORCEMENT - Enforcement of the Personal Cannabis ordinance will be done pursuant to Title 1, Division 2 <br />of the San Joaquin County Ordinance Code, unless otherwise specified in the Personal Cannabis ordinance. <br />ADMINISTRATIVE CIVIL FINE/ PENALTY FOR VIOLATIONS - Each violation of the Personal Cannabis <br />ordinance is a separate and distinct unlawful violation subject to the following administrative civil fine/ penalty: <br />Each violation, except for the violation of specified in subsection (b), is subject to an administrative civil <br />fine/ penalty of five hundred dollars ($500.00) per day from the date of the notice of violation and order to <br />abate and continuing for each day thereafter until the violation is abated by whatever means. <br />Each cannabis plant in excess of the legal six plant limit is subject to an administrative civil fine/ penalty <br />of up to one-thousand do!lars ($1,000.00) per day from the date of the notice of violation and order to <br />abate and continuing for each day thereafter until the violation is abated by whatever means. <br />The administrative fine/ penalty amounts shall be cumulative where multiple violations are cited and <br />where multiple administrative citations are issued. <br />ENFORCEMENT COST - The County shall be reimbursed for all time, services, and materials needed to abate a <br />violation of the Personal Cannabis ordinance. <br />PERMIT - If a corrective action required to comply with this notice involves the permitting, improvement, and/or <br />repair to a structure, then, prior to commencing work, you must secure the required permits from the San <br />Joaquin County Building Division located at 1810 East HazeIton, Stockton, CA. The Building Division's <br />telephone number is (209) 468-3121. <br />REQUEST FOR HEARING - Any person issued an administrative citation may contest the citation by completing <br />a request for hearing form and returning it to the San Joaquin County Environmental Health Department (EHD) <br />within 14 days from the date of the administrative citation by delivery or mail to the EHD at 1868 East HazeIton <br />Avenue, Stockton, CA 95205. The EHD telephone number is (209) 468-3420. The form must be filed with an <br />advance deposit of the total fine/penalty or a Hardship Waiver. <br />EHD 2(3-22)
