4 Environmental Analysis <br /> 4.3 Air Quality <br /> Regulation VIII—Fugitive PM10 Prohibition. Rule 8021 Construction, Demolition, Excavation, <br /> Extraction, and Other Earth-moving Activities. Pursuant to Rule 8021 Section 6.3, the Project <br /> would be required to develop, prepare, submit, obtain approval of, and implement a Dust Control <br /> Plan, which would reduce fugitive dust impacts to less than significant for all construction phases <br /> of the Project. Table 8021-1 within Rule 8021 provides control measure options for construction, <br /> excavation, extraction, and other earth-moving activities. <br /> Regulation IX—Mobile and Indirect Sources. Rule 9510 Indirect Source Review (ISR). The <br /> ISR rule went into effect March 1, 2006, and requires developers of new residential, commercial, <br /> and some industrial projects to reduce NOX and PM10 emissions generated by their projects. <br /> Pursuant to Rule 9510, the purpose of the ISR program is to reduce emissions of NOX and PM10 <br /> from new land development projects. Section 6.0 of the ISR rule outlines general mitigation <br /> requirements for developments that include reduction in construction emissions of 20 percent of <br /> the total construction NOX emissions and 45 percent of the total construction PM10 exhaust <br /> emissions. The rule also requires the Project to reduce operational NOX emissions by 33.3 percent <br /> and operational PM10 emissions by 50 percent, as compared to the baseline. Section 7.0 of the <br /> ISR rule includes fee schedules for construction or operational excess emissions of NOX or PM10 <br /> if those emissions are above the goals identified in Section 6.0 of the rule. Monies collected from <br /> this fee are used by the SJVAPCD to fund emission reduction projects in the SJVAB on behalf of <br /> the Project. <br /> Rule 9610—State Implementation Plan Credit for Emission Reductions Generated through <br /> Incentive Programs. Rule 9610 provides an administrative mechanism for the SJVAPCD to <br /> receive credit towards California State Implementation Plan (SIP) requirements for emission <br /> reductions achieved in the SJVAB through incentive programs administered by the SJVAPCD, <br /> Natural Resources Conservation Service (NRCS), or CARB. On April 9, 2015, the USEPA <br /> finalized a limited approval and limited disapproval (for a minor administrative error) of Rule 9610 <br /> as a revision to the California SIP. Additional documentation regarding the effectiveness of the <br /> SJVAPCD's incentive programs can be found in 2015 Annual Demonstration Report SIP Credit <br /> for Emission Reductions Generated Through Incentive Programs (SJVAPCD 2015b). <br /> San Joaquin County General Plan <br /> In 2016, San Joaquin County published their 2035 County General Plan (San Joaquin County <br /> 2016). The 2035 General Plan presents a vision for the County's future and provides strategies <br /> to implement the plan. The General Plan addresses geographic areas in the County that are <br /> unincorporated. The Plan serves as the County's "blueprint" for future land use, development, <br /> preservation, and conservation in the County. Air quality is addressed in the Public Health and <br /> Safety Element (Chapter 3.3 of the General Plan) and specifies the following policies that are <br /> relevant to the Project: <br /> Goal PHS-5: To protect public health, agricultural crops, scenic resources, and the built and <br /> natural environments from air pollution. <br /> 0o PHS-5.2 San Joaquin Valley Air Pollution Control District Coordination.
