4 Environmental Analysis <br /> 4.10 Hydrology/Water Quality <br /> oo The discharge does not contain toxic constituents in toxic amounts or (other) significant <br /> quantities of pollutants; <br /> oo The discharge is monitored and meets the applicable numeric action levels; and <br /> oo The discharger reports the sampling information in the SWPPP Annual Report. <br /> Federal Emergency Management Agency <br /> FEMA determines flood elevations and floodplain boundaries and distributes the flood insurance <br /> rate maps used in the National Flood Insurance Program. These maps identify the locations of <br /> special flood hazard areas, including 100-year floodplains (i.e., areas that would have a 1 percent <br /> annual chance of flooding). <br /> Federal regulations governing development in a floodplain are set forth in Title 44, Part 60, of the <br /> Code of Federal Regulations. Those regulations enable FEMA to require municipalities <br /> participating in the National Flood Insurance Program to adopt certain flood hazard reduction <br /> standards for construction and development in 100-year floodplains. <br /> 4.10.2.2 State <br /> California Fish and Game Code Section 1602 <br /> The California Fish and Game Code, specifically under Section 1602, protects the natural flow, <br /> bed, channel, and bank of any river, stream, or lake under the jurisdiction of the California <br /> Department of Fish and Wildlife (CDFW). CDFW jurisdiction over lakes and streams <br /> encompasses the top of bank or edge of riparian vegetation (as determined by the edge of a <br /> "dripline"), whichever is farther (CDFW 1994). Applicants must submit a notification of lake or <br /> streambed alteration to the CDFW for any projects affecting the bed, bank, or flow of water <br /> considered to be under CDFW jurisdiction. The CDFW may issue a Lake and Streambed <br /> Alteration Agreement if it determines that the activity may substantially adversely affect fish and <br /> wildlife resources. <br /> Porter-Cologne Water Quality Control Act <br /> The Porter-Cologne Water Quality Control Act gives the State Water Resources Control Board <br /> authority over waters of the State and water quality. The RWQCBs have local and regional <br /> authority. The area of the Project site is under the jurisdiction of the Central Valley RWQCB. The <br /> Central Valley RWQCB prepares and periodically updates the Basin Plan. Pursuant to the CWA <br /> NPDES program, the Porter-Cologne Water Quality Control Act also delegates the authority to <br /> the RWQCBs to issue NPDES permits. If a proposed project or portion of a proposed project does <br /> not require a federal permit but does involve dredge or fill activities that may result in a discharge <br /> to waters of the State, the RWQCB has the option to regulate the dredge and fill activity under its <br /> state authority in the form of Waste Discharge Requirements. <br /> Sustainable Groundwater Management Act <br /> The Sustainable Groundwater Management Act of 2014 (Water Code Section 10723) provides a <br /> framework for sustainable management of groundwater resources. In groundwater basins <br /> designated by the Department of Water Resources as medium and high priority, local public <br /> agencies and locally controlled groundwater sustainability agencies are required to develop and <br /> implement groundwater sustainability plans (GSP) or alternatives to GSPs.
