Code §§ 53311-53368.3) (the "Mello-Roos Act") including <br /> approval of the Rate, Method of Apportionment and Manner of Collection of Special Tax <br /> ("RMA")for the purpose of financing the services and maintenance of certain public <br /> facilities/improvements, specifically including maintenance of open space, landscaping, trails <br /> and habitat, and parks. Developer agrees that the boundaries of the Services CFD will include <br /> all of the Property, and that Developer will not contest and will, for and on behalf of all of the <br /> Property, vote in favor of formation of or annexation into the Services CFD prior to filing the first <br /> final map. Developer shall pay its fair share of administrative costs incurred by the District <br /> associated with the formation of and/or annexation into the Services CFD, as determined by the <br /> District Engineer. If formed prior to July 1, 2024, the District agrees that the amount of the <br /> services special tax will not exceed $533 per residential unit in the first year, with subsequent <br /> years being subject to typical inflationary adjustments as may be specified the RMA. Timing: <br /> Property included in the Services CFD prior to final map recordation. <br /> aaaa. Developer agrees to cooperate in the formation of, or annexation into, a community facilities <br /> district or districts (the "Facilities CFD") established pursuant to the Mello-Roos Community <br /> Facilities District Act of 1982 (Gov. Tract 3618 shall be incorporated into the existing SPIII lighting and landscape maintenance district prior <br /> to recordation of the final map unless an alternative such as an Community Facilities District is formed <br /> 4. A qualified environmental professional shall prepare a surface and subsurface contamination report, <br /> identifying any potential source of surface or subsurface contamination caused by past or current land uses. <br /> The report shall include evaluation of non-point source of hazardous materials, including agricultural <br /> chemical residues, fuel tanks, septic systems or chemical storage areas. A site assessment prepared in <br /> accordance with ASTM standards to assess the presence of any fuel, pesticide or chemical residue on or <br /> Resolution Template 01/2023 <br />
