Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />September 18, 2023 <br /> Facility Address: <br /> 3330 N AD ART RD, STOCKTON <br /> Facility Name: <br /> CAL TRANS- STOCKTON NORTH <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 2 HSC 25505, 25508(a)(1) Failed to initially complete and electronically submit a hazardous materials business plan <br />(HMBP). <br />OBSERVATION: Business has been storing onsite reportable quantities of hazardous materials for more than 30 <br />days and has not submitted a complete Hazardous Materials Business Plan electronically to the California <br />Environmental Reporting System (CERS). <br />The Environmental Health Department emailed Juan Armanderez to submit the HMBP on 08/11/2023. HMBP has <br />not been submitted to CERS. <br />REGULATION GUIDANCE: As of January 1, 2013, all businesses were required to submit all business plans <br />electronically. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 3 HSC 25507 Failed to establish and implement a HMBP. <br />OBSERVATION: A Hazardous Materials Business Plan has not been established or implemented. Discussed with <br />Su Huynh and was not aware of the HMBP. <br />REGULATION GUIDANCE: A Hazardous Materials Business Plan (HMBP) shall be established and implemented <br />for emergency response to a release or threatened release of a hazardous material when storing hazardous <br />materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or <br />200 cubic feet for compressed gas, at standard temperature and pressure. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a <br />statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. <br />This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business has been on site for <br />more than 30 days/ exact date is unknown.
