Load Checking Program <br /> Tracy Material Recovery&Transfer Facility <br /> 30703 S. MacArthur Drive, Tracy, CA 95377 <br /> Section 1161. <br /> The Load Checker will explain to the customers that future incidents will be <br /> reported to the local authorities. <br /> If the Load Checker suspects that customer may illegally dispose of the waste <br /> after leaving the facility, the Load Checker should write the license plate number <br /> of the hauling vehicle on the rejected canisters of PW with a permanent marker. <br /> If the waste is found illegally dumped after this point, the load check report and <br /> the abandoned canisters can be turned over to the regulatory agencies. <br /> If the customer is no longer on site and not identifiable, the Load Checker will <br /> remove the PW from the waste load and store it in the onsite hazardous waste <br /> storage container. <br /> 8.2. Commercial Load <br /> In general, when PW is found in commercial loads the responsible party is not on <br /> site. When PW is found in commercial loads in incidental amounts (small <br /> quantities, less than five gallons) the facility will normally assume the <br /> responsibility for the proper disposal of the waste. <br /> When PW is found in commercial loads in quantities greater than five gallons, the <br /> Load Checker will segregate the waste and will follow procedures in Section 9 to <br /> identify the responsible party and in Section 10 to report the incident to the <br /> appropriate agencies if necessary. The Load Checker or the Operations Manager <br /> will communicate with the responsible party informing them why these materials <br /> are unacceptable for disposal and inform the responsible party that future <br /> incidents will be reported to the local authorities. The Load Checker will have the <br /> responsible party arrange a time and place to take responsibility for the waste. <br /> If the responsible party is a business the Load Checker or the Operations <br /> Manager must request to speak to a supervisor. <br /> 9. Responsible Party Identification <br /> Responsible party means the person or business that is the legal owner of the PW. <br /> When the responsible party can be identified, they can be held responsible for the cost <br /> associated with the proper disposal of the PW. It is important to identify the responsible <br /> party so they can be notified that they illegally disposed of PW at a facility that is not <br /> authorized to accept it and that they must make arrangements for the pick-up and <br /> proper disposal of the waste. This action helps to ensure the responsible party will <br /> follow proper disposal procedures in the future. When the responsible party cannot be <br /> identified, the facility becomes the legal owner of the PW and must pay for the proper <br /> handling, transportation and legal disposal of the PW. The following are the necessary <br /> steps that the load checker must take to identify the responsible party. <br /> 13 <br />
