Legal Description of Facility : <br /> The legal description of this facility is described on page 5 of the Report of Facility Information dated June 2013 . <br /> 13 . Findings : <br /> a . San Joaquin County Integrated Waste Task Force has concluded that the Tracy Material Recovery & Transfer Facility is <br /> consistent his permit is consistent with the San Joaquin_ County Integrated Waste Management Plan, which was approved by <br /> CalRecycle March 1997 . The location of the facility is identified in the Countywide Non-disposal Facility Element, pursuant to <br /> Public Resources Code (PRC) , Section 50001 (a) . <br /> b. This permit is consistent with the standards adopted by CalRecycle, pursuant to PRC 44010 . <br /> C* The design and operation of the facility is consistent with the State Minimum Standards for Solid Waste Handling and Disposal <br /> as determined by the enforcement agency, pursuant to PRC 44009 . <br /> d. The Tracy Rural Fire Protection District has determined that the facility is in conformance with applicable fire standards, <br /> pursuant to PRC, 44151 . <br /> e. An Environmental Impact Report (EIR) SCH #93042093 ; a Negative Declaration (ND) SCH# 2008022020 ; and a Mitigated <br /> Negative Declaration (MND) , SCH# 201102013 were was filed with the State Clearinghouse and certified by the San Joaquin <br /> County Community Development Department. The CEOA documents describe and support the design and operation which will <br /> be authorized by the issuance of this permit. <br /> 14. Prohibitions : <br /> The permittee is prohibited from accepting any liquid waste sludge, non-hazardous waste requiring special handling, designated <br /> waste, or hazardous waste unless specifically listed below and unless the acceptance of such waste is authorized by all applicable <br /> permits the following wastes : Tires, White Goods, Household Hazardous Waste, Green Waste, and Food Waste . <br /> The permittee is additionally prohibited from accepting/handling the following items : Untreated Medical Waste, Large Dead <br /> Animals, Open Burning, Biosolids , Radioactive Waste, and Asbestos Containing Waste . <br /> Hazardous, radioactive, medical (as defined in Chapter 6 . 1 , Division 20 of the Health and Safety Code) , liquid, designated, or <br /> other wastes requiring special treatment or handling, except as identified in the Report of Facility Information and approved <br /> amendments thereto and as approved by the enforcement agency . <br /> 15.
