Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />November 06, 2023 <br /> Facility Address: <br /> 839 E DR MARTIN LUTHER KING JR BLVD, <br /> Facility Name: <br /> ADVANCE AUTO PARTS #9866 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 3 HSC 25507 Failed to establish and implement a HMBP. <br />OBSERVATION: A Hazardous Materials Business Plan has not been established or implemented. <br />REGULATION GUIDANCE: A Hazardous Materials Business Plan (HMBP) shall be established and implemented <br />for emergency response to a release or threatened release of a hazardous material when storing hazardous <br />materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or <br />200 cubic feet for compressed gas, at standard temperature and pressure. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a <br />statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. <br />This is a Class II violation. <br /> 6 HSC 25505(a)(2) Failed to electronically submit a site map with all required content. <br />OBSERVATION: The site map submitted to CERS is inconsistent with the current facility's layout. Include the <br />following on the site map: <br />- north orientation, loading areas, adjacent streets, storm and sewer drains, access and exit points, emergency <br />shutoffs. evacuation staging areas. hazardous materials handling and storage areas, and emergency response <br />equipments (fire extinguishers, spill kits, and eye wash stations). <br />REGULATION GUIDANCE: A site map shall contain a north orientation, loading areas, internal roads, adjacent <br />streets, storm and sewer drains, access and exit points, emergency shutoffs, evacuation staging areas, hazardous <br />material handling and storage areas, and emergency response equipment. <br /> If a site map element is not applicable for your facility then list it on the map and label as “NA". <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a minor violation. <br /> 12 HSC 25505(c) Failed to have the HMBP readily available to facility or EHD personnel. <br />OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon <br />request. Employees do not have access to the Emergency Response Plan and the inventory information on-site. <br />REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information required <br />by this article, and the site map required by this section shall be readily available to personnel of the business or the <br />unified program facility with responsibilities for emergency response or training pursuant to this section. <br />CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection.
