FINDINGS FOR VARIANCE <br /> PA-2300203 <br /> MONTEZUMA FIRE DISTRICT / CHIEF EDWARD MARTEL <br /> Finding 1 : Special Circumstances <br /> Because of the special circumstances applicable to the property , including size , shape , topography , location , <br /> or surroundings , the strict application of the regulation deprives the property of privileges enjoyed by other <br /> property in the vicinity and under identical zoning classification . <br /> This finding can be made because the facility is a fire station located on a residential lot . A fire station <br /> is a permitted use in the R- L zone . However, the existing residential lot cannot accommodate the <br /> necessary equipment storage due to the parcel ' s limited size and the increased setbacks for a corner <br /> lot . The zone requires a 5 -foot minimum setback for any proposed structures from the side property <br /> line . The proposed Variance for a detached accessory covered parking structure is considered infill <br /> development at an existing fire station . The proposed location for the accessory structure is currently <br /> being utilized for parking , and the proposed carport structure will protect the equipment from the <br /> elements extending the functional life expectancy of the equipment . <br /> Finding 2 : No Detriment <br /> The Variance will not be detrimental or injurious to property or improvements in the vicinity of the subject <br /> property , or the public health , safety , or general welfare . <br /> This finding can be made because the applicant is proposing to build an area fire separation wall that , <br /> in the event of a fire , will reduce any risks to neighboring properties . The proposed carport will require <br /> a building permit and be subject to the California Building Code which contains the allowance of the <br /> Variance and will not be injurious to property or improvements in the vicinity of the subject property <br /> or the public health , safety , or general welfare . <br /> Finding 3 : No Special Privileges <br /> The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations <br /> upon other properties in the vicinity and zone in which the property is situated . <br /> This finding can be made because a fire station is a permitted use in the R= L zone and the granting of <br /> this Variance to allow the fire station to cover equipment . The Variance is necessary due to the special <br /> circumstances related to the fire station . Additionally , as a Condition of Approval , if the fire station <br /> ceases to operate on site , the variance will no longer apply and all structures will need to meet <br /> minimum setbacks for the zone . <br /> Finding 4 : Use Authorized <br /> The Variance will not authorize a use or activity which is not otherwise expressly authorized by the regulation <br /> governing the parcel of property . <br /> This finding can be made because the Variance application does not authorize a use that is not <br /> otherwise expressly authorized by the General Plan or Development Title . Fire stations are a permitted <br /> use in the R= L zone ( Use Type : Public Safety Facility) . Additionally, accessory structures are allowed <br /> for permitted uses in the R= L zone , and the proposed carport structure would cover the existing <br /> parking area for the fire truck. <br /> PA- 2300203 — Findings 1 <br />
