• This finding can be made because the proposed subdivision, along with its design and future <br /> improvements, is not likely to cause substantial environmental damage or substantially and <br /> avoidably injure fish,wildlife,or their habitat.Although the project anticipates future <br /> residential development on the newly created parcels,all ground-disturbing activities— <br /> including the installation of infrastructure such as roads,electrical connections,wells,and <br /> septic systems—will be subject to environmental review and compliance with the San <br /> Joaquin County Multi-Species Habitat Conservation and Open Space Plan (SJMSCP). No <br /> sensitive habitat areas or protected biological resources have been identified on the site <br /> through preliminary environmental review.As a result,and with compliance with all <br /> applicable environmental regulations and permitting requirements,the project is not <br /> expected to result in substantial environmental impacts to fish,wildlife,or their habitat. <br /> 4. The proposed subdivision, together with the provisions for its design and improvement, is not likely to <br /> cause serious public health problems. <br /> • This finding can be made because the future development on the proposed parcels will be <br /> limited to one single-family dwelling,one accessory dwelling unit(ADU),and one junior <br /> accessory dwelling unit(JADU) per parcel,as allowed under the AG-40 zoning designation. <br /> Environmental Health Department standards related to water and wastewater services will <br /> apply to each new parcel.The Initial Study prepared for the project found no significant <br /> impacts to public health,and therefore,the subdivision is not anticipated to cause serious <br /> public health problems. <br /> 5. The proposed subdivision, together with the provisions for its design and improvement,will not <br /> conflict with easements acquired by the public at large for access through or use of property within <br /> the proposed subdivision.The County may approve a map if it finds that alternate easements for <br /> access or for use will be provided and that these easements will be substantially equivalent to ones <br /> previously acquired by the public. <br /> • This finding is supported because the proposed subdivision does not interfere with any <br /> existing public easements for access or use.A new access easement is proposed as part of <br /> the project design,which would provide legal access to all resulting parcels.This easement <br /> will be recorded and constructed in compliance with County standards and will ensure <br /> continued access in a manner substantially equivalent to any existing public rights. if <br /> alternate access routes are determined to be necessary,such easements will also meet the <br /> County's requirements for design and function. <br /> 6. Water and wastewater disposal services will be available and sufficient to serve a proposed <br /> subdivision. If the subdivision has more than 500 dwelling units, this finding must be in accordance <br /> with Section 66473.7 of the Subdivision Map Act. <br /> This finding can be made because all parcels created under the subdivision will rely on <br /> private wells and individual septic systems for water and wastewater disposal,consistent <br /> with AG-40 development standards.These systems will be subject to approval by the <br /> Environmental Health Department.The proposed subdivision does not exceed the threshold <br /> of 500 units and is therefore exempt from the requirements of Government Code Section <br /> 66473.7. <br /> PA-2400223 and Major Subdivision No. PA-2300266— Findings 4 <br />
