OBSERVATION: 1)The 91 relay was replaced on 12/1/2022 and the EHD was not notified. 2)According to the service technician and manager onsite, the 89 tank was converted to 87 and pipes were manifolded at the dispenser.A notification was not provided to the EHD. 3)The standalone sensor in UDC 11/12 was replaced on 1/2/2024 and the EHD was not notified. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD . A"Failure to Obtain a Permit"penalty applies. This is a repeat violation, Class II. 304 CCR 2631(a); HSC 25290.1(c) Failure to construct, operate, and maintain primary containment as product-tight. OBSERVATION:A large amount of oily residue was observed in UDC 13/14, indicating a leak in the primary containment. REGULATION GUIDANCE:All primary containment for the UST system must be product tight. CORRECTIVE ACTION: Immediately have a properly licensed,trained, and certified contractor repair or replace the failed component(s), under permit and inspection of the EHD if necessary. This is a repeat violation, Class II. 305 HSC 25290.1,25290.2, 25291 Failed to maintain secondary containment(e.g.failure of secondary containment testing). OBSERVATION: The 4/2/2019 and 4/15/2022 secondary containment test results indicated failures on the 87-1, 87-2, 91, and diesel lines, sumps and UDCs. The failed components have not been repaired or replaced. REGULATION GUIDANCE:All secondary containment for the UST system must be capable of storing any released hazardous substance. CORRECTIVE ACTION: Immediately have a properly licensed,trained, and certified contractor repair or replace the failed component under permit and inspection of the EHD.
