Per Jose Hernandez,spill pallets are not <br /> routinely monitored for accumulation. <br /> REGULATION GUIDANCE:All facility spill control equipment shall be maintained as necessary to assure its proper <br /> operation in time of emergency. <br /> CORRECTIVE ACTION: Bring the spill pallets into proper working order by removing the liquid in the secondary <br /> containment and placing in the proper waste container. Provide a corrective action statement to the San Joaquin <br /> County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 601 CCR 66262.34(a)Stored hazardous waste on site longer than 90 days without a permit or authorization. <br /> OBSERVATION: The following hazardous waste containers were found on-site with an accumulation start date of <br /> greater than 90 days or no accumulation start date: <br /> -A 55-gallon drum of used motor oil was observed with an accumulation start date of 6/10/2020 <br /> REGULATION GUIDANCE: <br /> (a)a generator may accumulate hazardous waste on-site for 90 days or less <br /> (b)The beginning of the 90 day period is determined as follows: <br /> (1)if the generator does not generate more than 100 kilograms of hazardous waste or one kilogram of acutely <br /> hazardous waste(listed in section 66261.33(e))or one kilogram of extremely hazardous waste during any calendar <br /> month, the 90 day period begins on the date the generator has accumulated 100 kilograms of hazardous waste or <br /> one kilogram of acutely hazardous waste or one kilogram of extremely hazardous waste; <br /> (2)if the generator generates more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous <br /> waste or one kilogram of extremely hazardous waste during any calendar month,the 90-day period begins on the <br /> first date on which any amount of hazardous waste begins to accumulate during that month. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 90 days in <br /> compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the <br /> disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection. A complete report was <br /> finished on 12/13/2023 and replaces the initial checklist. Item#302 was changed to#303. Item#119 was added. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, within 30 days of receiving the complete inspection report, 1/12/2024. <br /> Minor violation corrected on site. Multiple containers with universal waste were observed without labeling.
