Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />February 27, 2024 <br /> Facility Address: <br /> 2650 WIGWAM DR, STOCKTON <br /> Facility Name: <br /> ALL PRO COATINGS LLC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 7 HSC 25505(a)(3) Failed to electronically submit an adequate ER procedures for a release or threatened release. <br />OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. The following were <br />inaccurate on the plan: <br />- CUPA phone number <br />- Section D. Emergency Containment and Cleanup Procedures <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br /> - evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: This was corrected on site by updating the plan with correct information and uploading into <br />the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/ <br />This is a repeat violation, Class II. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. <br />- The 2022 business plan submittal was submitted on time on 12/13/2021 but was incomplete (missing Emergency <br />Response and Training Plan element) <br />- The 2023 business plan submittal was submitted on time and was complete on 11/9/2022 <br />- The 2024 business plan submittal was submitted late on 2/20/2024 and was incomplete (missing Emergency <br />Response and Training Plan element) <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: This was corrected on site by uploading the missing element into the CERS at <br />http://cers.calepa.ca.gov/ <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were two violations during the <br />inspection. All violations were corrected on site. No additional follow up is required. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($162).
