Legal Description of Facility: <br /> <br />The legal description of this facility is contained in Figures 1 – 9 of the Transfer/Processing Report dated October 2003. <br />SECTION 3 OF TOWNSHIP 1S, RANGE 7E, MOUNT DIABLO BASELINE AND MERIDIAN, APN: 201-060-03. <br /> <br />13. Findings: <br /> <br />a. This permit is consistent with the San Joaquin County Integrated Waste Management Plan, which was approved by the CIWMB <br />on March 29, 1995. The facility is identified and described in Non Disposal Facility Element, pursuant to Public Resources Code <br />(PRC), Section 50001(a). <br /> <br />b. This permit is consistent with the standards adopted by the California Integrated Waste Management Board (CIWMB), pursuant <br />to PRC 44010. <br /> <br />c. The design and operation of the facility is consistent with the State Minimum Standards for Transfer and Processing of solid waste <br />as determined by the local enforcement agency (LEA), pursuant to PRC 44009. <br /> <br />d. The Manteca – Lathrop Fire Department has determined that the facility is in conformance with applicable fire standards, <br />pursuant to PRC, Section 44151. <br /> <br />e. An Environmental Impact Report was filed with the State Clearinghouse (SCH #2001052081) and certified by the SJC Planning <br />Commission on February 6, 2003 . The Environmental Impact Report describes and supports the design and operation, which will <br />be authorized by the issuance of this permit. A Notice of Determination was filed with the State Clearinghouse on 4/14/03. <br /> <br />14. Prohibitions: <br />Composting Site – The permittee is prohibited from <br />accepting any hazardous wastes, medical wastes, <br />cannery waste, and dead animals unless such waste is <br />specifically listed below: <br /> Tires <br /> Sewage sludge <br /> Non-hazardous liquids/slurries <br /> Agricultural yard wastes <br /> Non-hazardous solid or inert ashes <br /> Designated waste ashes <br /> Food wastes <br /> Manure <br /> Mixed wastes <br /> Scavenging prohibited. <br /> <br />Transfer Station – The permittee is prohibited from <br />accepting hazardous wastes, medical wastes, dead <br />animals, and cannery wastes unless such waste is <br />specifically listed below: <br /> Agricultural <br /> Construction/demolition <br /> Industrial <br /> Mixed municipal <br /> Wood & mill wastes <br /> Non-hazardous liquids/slurries <br /> Food wastes <br /> Tires <br /> <br />Scavenging prohibited. <br /> <br />15.
