Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 18, 2024 <br /> Facility Address: <br /> 1627 INDUSTRIAL DR, STOCKTON <br /> Facility Name: <br /> American Power Systems, LLC - Stockton <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted <br />late on 2/19/2018 for the year of 2018. The business plan was submitted late on 2/7/2019 for the year of 2019. The <br />business plan was submitted late on 2/17/2020 for the year of 2020. The business plan was submitted late on <br />2/16/2021 for the year of 2021. The business plan was submitted late on 2/25/2023 for the year of 2023. The <br />business plan was submitted incomplete on 11/9/2023 for the year of 2024, only the facility section was submitted. <br />The inventory section was submitted on 2/5/2024 for the year of 2024. The plans section has not been submitted for <br />the year of 2024. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 3 violations found during the <br />inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions that have been or will be taken for each violation, and any <br />supporting paperwork, by 5/18/2024. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($162).
